1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ReNieuw ("we," "our," or "us") governing your access to and use of our packaging recyclability assessment tool and related services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

ReNieuw provides a web-based tool for assessing the recyclability of packaging materials. The Service allows users to:

  • Evaluate packaging formats against recyclability criteria
  • Receive guidance on improving packaging recyclability
  • Save and manage packaging assessments
  • Export assessment reports
  • Access educational resources about packaging sustainability

3. Important Disclaimers

Assessment Results Are Guidance Only

The recyclability assessments provided by ReNieuw are for informational and guidance purposes only. They do not constitute certification, legal advice, or guarantee of recyclability in any specific market or recycling system.

You acknowledge and agree that:

  • Assessment results are based on the information you provide and our interpretation of industry guidelines
  • Actual recyclability depends on local infrastructure, collection systems, and sorting capabilities
  • Recycling standards and regulations may change over time
  • Our tool uses methodologies based on RecyClass, CEFLEX, and other industry guidelines, but is not endorsed by or affiliated with these organizations
  • You should verify recyclability claims with relevant authorities before making public claims or regulatory submissions

4. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Promptly update your account information if it changes
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or use automated means to access the Service without permission
  • Misrepresent your identity or affiliation
  • Use assessment results in a misleading or deceptive manner

6. Intellectual Property

6.1 Our Content

The Service and its original content (excluding user-provided data), features, and functionality are owned by ReNieuw and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of the packaging information and assessment data you provide. By using the Service, you grant us a limited license to use this data to provide and improve our services.

6.3 Assessment Reports

You may use assessment reports generated by the Service for your internal business purposes. You may share reports with your stakeholders, but you may not resell or redistribute them as a commercial product.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not warrant that the Service will be uninterrupted, error-free, or secure
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless ReNieuw and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any claims made based on assessment results you have shared or published

10. Changes to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

We may revise these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

11. Termination

You may terminate your account at any time through the account settings page or by contacting us.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
